1. This agreement

These terms are an agreement between you and Infynex Ltd, a company registered in Mauritius, which provides Komann. By creating an account or using Komann you accept them. If you use Komann for a business, you confirm that you may accept them for that business. The Privacy Policy explains how personal data is handled and forms part of these terms.

2. What Komann does

Komann helps a seller record orders, customers, stock, payments that customers report, deliveries and what is owed to drivers, and gives each customer a private page for their order.

Komann never holds, moves or collects money. A payment report from a customer is only their statement that they paid. Only the seller can confirm that money arrived, after checking their own bank account, and the seller alone is responsible for that decision. Recording a driver settlement does not pay the driver.

3. Accounts

You must be at least 18 and give accurate details. Keep your password to yourself and tell us at once if you think someone else has used your account. You are responsible for what is done with your account. You can delete it at any time in the app.

4. Businesses, staff and drivers

The person who creates a business is its owner. The owner decides who is invited as staff or driver, can remove their access at any time, and is responsible for how the business uses Komann, including what its staff and drivers do in it.

5. Sellers’ responsibilities

If you sell through Komann, you are responsible for your products and prices, for delivering what you sell, for refunds and for your dealings with customers and drivers. You must comply with the laws that apply to your business, including consumer protection, tax and data protection law. You control the personal data you record about your customers: collect only what you need, use it only for their orders, share their private order link only with them, and answer their requests about their data. Infynex Ltd processes that data only on your behalf, to provide Komann to you, as the Privacy Policy describes.

6. Acceptable use

Do not use Komann to sell anything unlawful, to deceive or defraud anyone, to record false payments, to harass anyone, or to store personal data you have no right to hold. Do not try to reach data or businesses you have no access to, disrupt or overload the service, or copy, resell or reverse-engineer it except where the law allows. We may suspend or close an account that breaks these rules, and we will say why unless the law prevents it.

7. Price

Komann is free of charge at present. If we introduce paid features, we will tell you at least 30 days in advance, and you will not be charged unless you choose to pay.

8. Availability and changes

We work to keep Komann available and your records safe, with encrypted backups, but we cannot promise that it will be uninterrupted or error-free. We may change or improve Komann. We will give reasonable notice before removing a feature that businesses rely on, or before stopping the service, so that owners can keep what they need.

9. Liability

Komann is a record-keeping tool. We are not responsible for a seller’s decision to confirm a payment, hand over goods or pay a driver, nor for the goods and services sold through it. To the extent the law allows, Infynex Ltd is not liable for indirect loss or loss of profit, and our total liability to you in any year is limited to the amount you paid us for Komann in that year. Nothing in these terms limits liability that cannot be limited by law, or any right you have as a consumer.

10. Ending the agreement

You can stop using Komann and delete your account at any time. We may end these terms or suspend access if you seriously or repeatedly break them, or if the law requires it. What happens to your data then is described in the Privacy Policy.

11. Changes to these terms

We may update these terms. When a change matters, we tell you in the app at least 30 days before it takes effect. If you do not agree, you can delete your account before then.

12. Law and disputes

These terms are governed by the laws of the Republic of Mauritius, and the courts of Mauritius have jurisdiction. Please write to us first: most problems can be solved quickly.
